I hate going into smoky places, too, but people who stay up all night gambling or get drunk in bars have a peculiar selectivity over their health issues, don't you think? Decent restaurants I have been in are seldom smoky even if they allow it at the bar or elsewhere. I reek when I leave the homes I appraise owned by smokers. Whether I think I should be able to tell them they can't smoke on private property is a whole different subject.

I could live with a law which requires them to put a sign on the door that says, "Smoking permitted." If I did not care to patronize that place, I would go elswhere until I found an establishment that did not permit it.
Then the free market can decide. Smoking establishments will collapse if the majority of the public deems it that repugnant. But we all know this is really a backdoor way to ban smoking altogether, something no one has the guts to do. It's easier to peck around the edges.
Should we pass laws that say you can't smoke in your own house because you may be called on by appraisers, cable guys, cops, EMTs, refrigerator repairmen, babysitters or the like? Or your own kids need protection from you? It's certainly not healthful for them, and this is the logical extension of existing smoke-free laws.
