i got a letter from people magazine today.

the wrote an article about that big fat greek Nia Vardalos. i mean the movie starring her... i mean.. yeah.. well anyways.

so they mentioned she met the Queen on her jubilee visit to Winnipeg. except they spelt it "Winnepeg".

i e-mailed them telling them to consult their big fat greek atlas next time.

they replied:

oh and at the bottom of the e-mail had a lengthy legal statement saying something to the effect of me not being able to show anybody the e-mail they sent me or i'd be shot by Time Warner.

I figured they would just say that's the Americanized spelling. teehee.

I am amazed they wrote you back at all! It always surprises me how often country/city names are spelled wrong in publications.

Colombia, South America is very often spelled "Columbia". (Personal pet peeve)

It's not. It covers People's backside in case one of their "carefree" journalists (using the term loosely, of course) decides to libel someone via e-mail transmission.

true enough. but they can't stop me from showing someone a letter i got. i mean it's not gov't information or anything.

They're only trying to limit any liability to the person a writer might libel to a single entity. Damages multiply rapidly if the first entity who receives it passes it on. If they tell you you can't, and you do anyway, they're off the hook from a liability standpoint. Then YOU become the one who committed libel! Shocked

Damn lawyers.

I'm afraid you've missed the point. The issue is not criminal liability, but civil liability as it pertains to a libelous statement.

Libel is generally defined as a defamatory statement or representation especially in the form of written or printed words. It's usually a false published statement that injures an individual's reputation (as in business) or otherwise exposes him or her to public contempt.

Journalists are targets of libel suits when they write about public figures, as in the case of People magazine. If one of the writers published a libelous statement (about someone famous, for instance) in an e-mail and sent it only to you, the famous person could claim damages against People for the injury to their reputation as it pertains to you. If you pass it on, and People doesn't put the disclaimer on the e-mail, the famous person could logically claim damages for the injury to their reputation as it pertains to everyone else in line who received it.

With the disclaimer, People can offer a defense to extensive financial liability by saying, "We told the recipient not to pass it on. They should be held liable for recklessly doing so."

Your example of leaving a note admitting criminal guilt would not be libelous, since you would be making a statement about yourself. You can't commit libel against yourself.

As far as criminal liabilty goes, you wouldn't even have a case against the individual who revealed your information. The individual who finds out about the crime has a duty to report it, and is subject to criminal prosecution if they don't. Obstruction comes to mind, and if I scour the statutes, I could probably come up with a few others.

If you've committed a crime, this lawyer's advice would be to turn yourself in. But talk to an attorney first. Wink
