if a news team or some project uses your image on something that's going to be aired on tv or viewed for general public, shouldn't they get your permission? I can see on your local new station, if they see you doing something, they wouldn't have to. But say someone put together a tape and they use your name and news clips of you and then plays in public----shouldn't a person have a say so? If a person asks them to stop, do they "have" to?

AFAIK - If you're out in public, you're fair game.

After I got out of college, one of the local Eau Claire stations did a feature, a series, on how graduates were dealing with the real world - getting jobs, the usual - and I was one of the ones in the series. They did the usual - interviews, shots of me at work, etc. And they asked permission both before and after the filming.

Courtesy says they should stop if asked. Most times they will honor the request. Though if you are a "newstory" i.e a defendant walking out of court, I think it does not matter. In a common story, like "man on the street," I think you can respectfully decline.

what does AFAIK mean?

I guess I understand that, and I don't fear that someone is videotaping me when I'm at the grocery store, etc., but should a person be able to make a conglomeration of say "here's PH riding his bike to and from work" and hook it up in the local grocery store for everyone to view???

I think they have to ask if they are using your image in a commercial, or in a way seeking financial gain.

but how would you feel if your at your local grocery store and you hear your name and look up and see a videotape of yourself? Or if some of your friends start calling you and saying "hey, great tape at the grocery store" and you are clueless about what they are talking about?

no. My husband came home and said that a few coworkers said they saw me on tv....not a big deal, they must have had a quick sports clip and a shot of me finishing the race (I had no idea there were cameras there), but it just brought back a memory that I was a little uncomfortable about.

If it was a race shot, there is usually something in the waiver that says your image can/may be used for promotional purposes

I think we're on the cusp of big time controversy as a country. Picture cellphones are what's triggering it more and more. At my fitness center, they are already forbidden because of the possibilty of pics while you workout or worse, in the locker rooms. And another tidbit I heard the other day is people will use the picture cellphone to take quick shots of your credit card in a checkout line if you're not careful.
It's a crazy world.

You have NO EXPECTATION OF PRIVACY when you are out in public. That means you can be taped finishing a race or your participation in any other public event.

Being taped in a store is another matter. The store should have gotten your permission. Consult a lawyer, esp if your image was in a commercial.

We had video taped finishes once for a race. It was a little odd. But it later helped me identify someone for a blind date....
