DECATUR, (Ga) -- Drivers who cause a traffic accident while talking on a cell phone will face a fine of up to $500 under a law that took effect Tuesday in DeKalb County.
The law, believed to be the first of its kind in Georgia, sanctions drivers whose improper usage of a mobile phone was a "contributing factor" in a collision causing death, injury or damage.
County officials said the law applies in unincorporated DeKalb, not its cities. About 80 percent of the county is unincorporated.
The Board of Commissioners had been considering a $100 fine proposed by county Chief Executive Officer Vernon Jones, but they upped the ante when they approved the higher maximum fine Tuesday.
Jones said he proposed the legislation after driving past a wreck several months ago in which cell phone use reportedly played a role. He said he also talked to a county traffic court judge who told him cell phones were a factor in as many as 700 collisions in a year.
"It's becoming more and more of a problem," Jones said. He said the law does not target drivers who use headsets or handsfree devices.

I find that many cars that are roadhogs or are cutting into other peoples' lanes are driven by drivers using cellphones

Why not?  | less distractions and both hands on the steering wheel more often. i saw only one Bluetooth last night in my little observation time and this was during a heavy rain.

Every close call I have had on the motorcycle, has been with a 20 something yakking on a cell phone...

The problem I have with this law is it only affects persons such as me who live in unincorporated Dekalb County. All other residents of the county are not affected by this law.
Nor are any other residents of the State of Georgia affected. Just those of us without representation. It should be noted that the representative of my district voted against the law, I'm sure for the same reason as I oppose it. The same law should apply to everyone in the county, not just those of us in the unincorporated areas.
It's not the law itself I oppose. Just the fact I'm the one that want to make an example of for the rest of the State. If Hyper rear ends me in Fulton county yakking on his cell, there is no cell phone penalty.

two things wrong with this line Reb. I' have no Cell phone and i have no car.
i get you, i would love to see it actually federally enforced. From sea to shining sea would best.
