Rumor is some of the missing Ds are in New Mexico. Here is a statement from the New Mexico Secretary of State regarding the Governor's request to allow the Texas Department of Public Saftey to enter their state to arrest the lawmakers and return them to Austin..

The attorney general in New Mexico says Texas law enforcement officials probably can't go into that state to arrest missing state lawmakers — and she made clear she's not hot on looking for them.

Attorney General Patricia Madrid said if Texas issues arrest warrants for the officials, then New Mexico officials may act on them and extradition proceedings would have to be held.

Her comments came after Gov. Rick Perry's office asked New Mexico whether it would allow Texas officials to make arrests in that state. Madrid said the question is being researched. But she wasn't taking it all serious.

"Some are speculating this request from the Texas Governor's office concerns an effort to locate missing Texas House Democrats," Madrid wrote. "If so, Texas should understand that since ski season is over, the Santa Fe Opera has not begun and President Bush was just in town, I don't think they are in Santa Fe now. Nevertheless, I have put out an all-points bulletin for law enforcement to be on the look out for politicians in favor of health care for the needy and against tax cuts for the wealthy."

She also wrote that normal arrest procedures should be followed and "this is an internal political matter to be handled by Texas government officials."

In some ways, i find this all to be very fubby. I know it makes your job H-!! Alan. I guess it is the immaturity of it all. "I don't like the way the game is going so I'm taking my ball and going home!" Patricia Madrid is prolly right for saying that they would act on arrest warrants and extradition, but she isn't going to send out her troops to look for them. Kinda like, keep your arguments in Texas, don't bring them over here!

Sorry that it makes your life miserable Alan.

I'm really confused here, Alan. Is this legal? I'm assuming that since Texas wants to arrest those that are missing, it isn't. So what happens when they decide to come back to town?

What happened 20 years ago?

I can't wait to tell my husband. (he's working late tonight) He already has a theory you should never vote for the incumbent. This should really get him going.

Shame on New Mexico for not cooperating with us more. I vote we go steal more of their land.

Update---and remember, how can I make this stuff up?

The Speaker just announced they had found 40 of the missing (now nicknamed the "Killer Ds") legislators at a Holiday Inn in Ardmore, OK. As of 15 mins ago they were eating at Denny's and were being monitored by the Texas Department of Public Saftey, in conjuntion with Oklahoma law enforcement. The feds were working with Texas and Oklahoma to allow Texas to arrest the members and bring them back to Austin via a chartered plane. While no decisions have been made, the cops have them cornered--but no shoot-out is expected Mr. Green

So now we wait some more. They can have them back in Austin within two hours of getting the ok to force them back.

OL, this isn't an illegal action. What they have violated are the House of Representatives rules. And the rules allow the Speaker, with the approval of 25 additional members, to put a "call" on the House. When they do that, all members are forced to remain in the chamber and the law is sent to arrest the missing members and force their return to the House. No criminal act has been committed.

This happened in the Senate 24 years ago. That time the members hid in Austin, but the po-po couldn't find them. The Lt. Governor agreed to remove the legislation that forced that walkout from consideration and they returned en mass to the Senate chamber and became a legend in the Capitol.

I just watched an interview with some of the Dems from their Holiday Inn. They can't believe the Gov. would send troopers with guns and badges after them. Days like today I wish I was a government teacher!

How long do you think this will go on?

The legislative session ends on June 2. Starting yesterday and with each passing day a number of procedural deadlines take effect designed to bring an orderly winding down of business. At midnight Thursday it will not be possible for the redistricting map to be taken up by the House as a House Bill. So the standoff should end Friday morning when they return to Austin en mass.
