What pisses me off is that everyone is assuming she lied and that's why they're closing the case. What they said on Fox News is that she was unable to go on with the trial....um, hellloooo....someone LEAKED HER NAME and medical history to the press.......and of course any time there's a rape trial the victim is made to look like some stank ho who "deserved it" which in itself is a crime. This whole thing makes me sick. If he was just some average Joe (no pun intended, Po Po ) things would be a lot different. This sucks. I bet she ends up committing suicide over it.
One of our lawyers could probably explain this better but from what I understand about the prejudice thing, doesn't that mean they have 10 years to possibly reopen the case?

If you dismiss a case with prejudice, it's the equivalent of an adjudication on the merits of the case and final disposition.
It prevents you from bringing suit on the same claim. Period.
When a civil case is settled, a dismissal with prejudice is standard.

Not that I'm defending Kobe (or any other rape case)... but it my eyes, most men are guilty until proven innocent when it comes to these types of charges. Furthermore - If she wasn't prepared to get on the stand in this particular trial, then the prosecutors shouldn't have filled the charges. She appeared to be digging for a pot of gold in this case (after she bedded a major pro athlete).

I don't have a strong opinion either way. I just know that if you have a boatload of money, you can often dictate the outcome of such matters. A little case in 1995 proved that.

That is what our legal system is for. To hopefully discover the truth. The American legal system relies on truthful testimony from all participants. No one would lie about sex, would they?

I don't claim to know what happened that night, but I do think the judge botched the case more than anyone.
Also, anyone else find Kobe's apology very leading?
