NEW YORK (Reuters) - McDonald's Corp. won a major victory for the fast-food industry on Wednesday when a federal judge threw out a widely watched lawsuit that blamed Big Macs, fries and Chicken McNuggets for obesity in children.


U.S. District Judge Robert Sweet said the plaintiffs -- including a 400-pound teenager who said he eats at McDonald's every day -- failed to show that customers of the world's largest fast-food chain were unaware that eating too much McDonald's fare could be unhealthy.


But the judge did not let McDonald's off the hook completely. Referring to Chicken McNuggets as a "McFrankenstein creation" of elements not used by home cooks, he said the plaintiffs could refile their case with information backing their claim that diners have no idea what is really in their food or that the products have allegedly become more harmful because of processing.


At issue, the judge said, is where to draw the line between personal responsibility and society's responsibility to protect individuals. He also cited concerns the case could "spawn thousands of similar 'McLawsuits"' against all types of restaurants.


"This opinion is guided by the principle that legal consequences should not attach to the consumption of hamburgers and other fast-food fare unless consumers are unaware of the dangers of eating such food."

I'm happy and I'm sad. This lawsuit never should have gotten as far as it did. I don't think that judge went far enough for personal accountablility. He has left the door wide open for a freakin' warning label on my burger and fries. Society's responsibility to protect individuals? From what? Stupidity? Self-imposed ignorance? How about the need to protect society from increases in taxes and the cost of goods while these frivilous lawsuits go to court and subsequently are awarded outrageous settlements?

McDonalds does have a list of the nutrition facts for all their food usually posted near their counter.

I do agree that it should have never gotten that far.

everyday i cut myself with a knife. not on purpose, but because i like playing with them. it used to be all fun and games, but who knew about the infections i could get, or the excessive blood loss? i'm filing suit against a major knife manufacturing company for failing to inform me of this when i bought my knifes. how can anything so shiney so be so harmful? i'm writing this letter in hopes that we can fight back against corporations misleading us with slogans such as "it slices, it dices" and failing to leave out "...and will hurt you real bad like if you play with them". how was i to know? my only hope is that millions of dollars can make my pain go away, and maybe i'll be able to buy a new finger...
